This Privacy Policy describes how Motum Systems LLC ("Motum," "we," "us," or "our") collects, uses, and shares information in connection with our website at usemotum.com (the "Site") and our operations software and messaging services (the "Services").
By using the Site or Services, you agree to the practices described in this policy.
1. Who We Are
Motum Systems LLC is a New Jersey limited liability company operating under the brand name "Motum." We provide agentic operations software to service businesses, including automated communications and scheduling workflows.
For most end-user data processed through the Services, Motum acts as a service provider (processor) on behalf of our business customers. Our business customers are responsible, as the data controller, for the data they instruct us to process. See Section 6.
2. Information We Collect
Information you provide directly. When you contact us, request a demo, or book a walkthrough, we collect your name, email address, phone number, business name, and any information you include in your message.
Information collected through the Services. When our business customers use the Services, we process contact and scheduling information they provide, which may include names, phone numbers, and appointment details of the individuals they communicate with.
Information collected automatically. When you visit the Site, we may collect device and usage information such as IP address, browser type, pages viewed, and referring URLs through cookies and similar technologies. See Section 11.
3. How We Use Information
We use information to:
- Provide, operate, and improve the Site and Services
- Respond to inquiries and schedule demos or walkthroughs
- Send text messages and other communications you or our customers have authorized (see Section 4)
- Maintain security, prevent fraud, and comply with legal obligations
- Analyze usage to improve performance and user experience
4. SMS / Text Messaging
Motum sends text (SMS) messages to individuals who have provided prior express consent, either directly or through one of our business customers.
Consent. By providing your mobile phone number and opting in, you consent to receive text messages from Motum related to scheduling, appointment reminders, account notifications, and service updates. Consent is not a condition of purchase.
Message frequency. Message frequency varies based on your interactions and the services you or your provider have enabled.
Rates. Message and data rates may apply.
Opt-out. You can opt out at any time by replying STOP to any message. After you send STOP, you will receive one confirmation message and will not receive further texts unless you opt in again.
Help. Reply HELP for assistance, or contact us using the details in Section 13.
No sharing of mobile information. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent are not shared with any third parties. Information may be shared only with subprocessors that support message delivery (for example, our SMS carrier) solely to provide the Services, and never for their own marketing.
5. How We Share Information
We do not sell your personal information. We share information only in the following limited circumstances:
- Service providers / subprocessors. With vendors that help us operate the Site and Services (for example, hosting, analytics, and SMS delivery), under contractual obligations to protect the information and use it only to provide services to us.
- Business customers. With the business customer on whose behalf we process end-user data.
- Legal and safety. When required by law, subpoena, or to protect the rights, property, or safety of Motum, our customers, or others.
- Business transfers. In connection with a merger, acquisition, or sale of assets, subject to this policy.
Mobile phone numbers and SMS consent data are never shared for third-party marketing purposes under any circumstance.
6. Data Processed on Behalf of Our Customers
When a business customer uses the Services to communicate with or manage information about its own clients, members, or families, Motum processes that data only on the customer's instructions and for the purpose of providing the Services. The business customer is the controller of that data and is responsible for obtaining any required consents from the individuals involved.
If you are an end user of one of our business customers and want to exercise privacy rights, please contact that business directly. We will support them in responding to your request.
7. Children's Privacy
The Site and Services are not directed to children, and we do not knowingly collect personal information directly from children under 13.
Some of our business customers operate youth programs and may process information about minors through the Services. In those cases, the business customer is the controller and is responsible for obtaining verifiable parental consent where required by law, including the Children's Online Privacy Protection Act (COPPA). Motum processes any such information only on the customer's instructions and does not use it for its own purposes.
8. Data Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
9. Data Retention
We retain personal information for as long as needed to provide the Services, comply with legal obligations, resolve disputes, and enforce agreements. Data processed on behalf of a business customer is retained and deleted according to our agreement with that customer.
10. Your Rights
Depending on your location, you may have the right to access, correct, delete, or restrict the use of your personal information, and to opt out of certain processing. To exercise these rights, contact us using the details in Section 13. We will respond as required by applicable law.
11. Cookies and Analytics
The Site uses cookies and similar technologies to operate, secure, and analyze usage. Some third-party tools we use to schedule demos and measure Site performance may set their own cookies. You can control cookies through your browser settings; disabling them may affect Site functionality.
12. Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date above. Material changes will be reflected on this page.
